Times of India: Indian H-1B filings set to drop by 50% this year

I was quoted in the Times of India on April 4 regarding H-1B filings.

“H-1B visa rejection rates, including for renewals, have risen markedly. Stephen Yale-Loehr, professor of immigration law practice at Cornell Law School, said the number of H-1B petitions that received requests for additional evidence last year increased more than 40% over the previous year. “That trend is likely to continue this year,” he said.”

I was quoted in the April 6 New York Times article about visa backlogs for foreign nationals from India.

“No one should be stuck waiting more than 10 years for a green card. It hurts employers and employees and their families,” said Stephen Yale-Loehr, a professor of immigration law at Cornell Law School. “Indians are being held hostage by our broken immigration system.”

Times India: H-1B visa regime is likely to get tougher as Department of Homeland security mulls stricter restrictions on selection

I spoke with Times of India on December 25 regarding increased scrutiny of H-1B petitions.

The USCIS has done a lot in the past few months to make it harder to qualify for H-1B visas. The percentage of H-1B cases receiving a request for evidence has doubled to 41%. The USCIS is questioning whether some computer positions require a bachelor’s degree.

In addition to the USCIS taking longer to approve H-1B petitions, the State Department consulates are screening H-1B visa applications more carefully than before. All in all, it is harder than ever to get an H-1B these days.

I was quoted in a November 20 Univision article about the administration’s plan to eliminate work permits for spouses of H-1B temporary workers.

Para el profesor de la facultad de Derecho de la Universidad de Cornell, Stephen Yale-Loehr, la orden ejecutiva de Trump del 18 de abril “es una solución demasiado simple para un problema complejo”. Yale-Loehr cree que con los cambios anunciados por Trump las leyes de inmigración deben ser vigiladas “para asegurarnos que las compañías paguen el salario correcto, pero que no dañen la innovación en el proceso”.

Donald Trump signs executive order to reform H-1B visas

Al Jazeera reports on Trump’s “Buy American, Hire American” executive order demanding changes to the H-1B visa program. However, this executive order is an overly simple solution to a complex problem, and it limiting temporary work visas to boost US employment rates could have the opposite effect.

 

Immigrants account for a disproportionately large share of start-ups and patents in the United States, and for every H-1B position requested, U.S. tech companies increase their employment by five workers. Cutting the H-1B program pushes talented immigrants to look elsewhere, and this administration risks hurting the U.S. economy by accelerating the existing problem of off-shoring work and talent to other countries.
